Our Money Claims service enables you to file a claim in the County Court, helping you secure a County Court Judgment (CCJ) that can be enforced for up to six years. A money claim allows you to initiate a County Court claim for a specific sum owed, providing a letter before action LBA has been served in the fist instance on the debtor ensuring a leagel and direct path to securing a CCJ against the debtor. The process is designed for claims up to £100,000, with larger claims requiring manual submission to the court. Once you entrust us with your case, our experienced team will forward your details to our panel of solicitors, who will promptly file the claim online. The court typically processes claims within 14-20 working days, notifying the debtor and giving them 28 days to respond or file a defence. If no defence is submitted, our legal team will seek judgment jugment by default in your favour, resulting in an enforceable order. In the event of a dispute, the court will schedule a hearing to review evidence and issue further directions.

What is the Money Claims Service?

A Money Claim is a legal procedure used to recover money that is owed to you. This service allows you to initiate a claim through the County Court, seeking a monetary judgment against the debtor. Our Money Claims service manages every step of the process, from preparing and filing the claim to handling any disputes. If successful, the outcome is a County Court Judgment (CCJ), which legally confirms the debt and can be enforced for up to six years at any address for the debtor through a trace. 

How It Works

  3. Claim Processing: The County Court processes the claim within 14-20 working days and notifies the debtor, who is then given 28 days to respond or file a defence.
  4. Judgment in Your Favour: If the debtor fails to respond or defend the claim, we request the court to issue a judgment by default in your favour, securing a County Court Judgment (CCJ) against the debtor.

FAQs

Use the Money Claims service if you are owed a specific sum of money (up to £100,000) and previous efforts to recover the debt have been unsuccessful.

The court usually processes claims within 14-20 working days. If the debtor does not respond, a judgment can be obtained shortly after. If the claim is disputed, the process may take longer as the court schedules a hearing.

If we are unable to trace the debtor, you will only be charged a small administrative fee. For UK searches, this fee is £50, while for European searches, it’s £70.

If the debtor fails to respond within 14 days, we will request a default judgment, resulting in the issuance of a County Court Judgment (CCJ) against them.

If the debtor disputes the claim, a court hearing will be scheduled. Our legal team will represent you, presenting the necessary evidence to support your case and seek a judgment in your favour.

A CCJ is a legal judgment that formally recognizes the debt owed to you. It remains in place for six years and can be enforced through methods like bailiff services, wage garnishment, or other legal measures if the debtor fails to pay.
