Your tenant is still there. A possession order isn't an eviction. If the tenant doesn't leave by the date in the order, you need a warrant of possession so County Court bailiffs can remove them. We handle the application, the paperwork and the coordination, up to eviction day. ### When you need it - The date in an outright possession order has passed and the tenant hasn't moved out. - The tenant has broken the terms of a suspended possession order. - You want the eviction done lawfully, without risking a harassment or illegal eviction claim. If you used Possession Claim Online, it can be requested online. The court fee is £152. 2. **Appointment issued.** The court sends form EX96 with the eviction date, and usually a risk assessment form (EX97A). 3. **Forms returned.** They must be back with the court at least 3 working days before the eviction, or it may be cancelled. We handle this for you. 4. **Tenant notified.** The court gives the tenant notice of the eviction date. 5. **Eviction day.** Meet the bailiff outside the property and don't go in until they say so. Have a locksmith ready to change the locks straight away. ## How long does it take? Waits for a bailiff appointment vary widely by court, from weeks to several months. Where waits are long, you can ask the court for permission to transfer to the High Court (£126), where an enforcement officer may act sooner.
